This Terms of Service Agreement (“Agreement”) is made between Code for America Labs, Inc (“CFA”) and the Community Based Organization (“CBO”) who completes the application and registration process to open and maintain an account on the GetCalFresh (getcalfresh.org) service.
All users of the GetCalFresh.org CBO assister dashboard, including Admins and Assisters, must read and agree to these terms. You cannot share login information with anyone, including other members of your organization. Admins can create and disable as many assister accounts as is necessary for the CBO’s tracking and reporting needs. By clicking the acceptance button, you agree to all of the terms of this agreement, as well as the GetCalFresh Privacy Policy. Do not use the service if you do not accept the terms.
GetCalFresh (“Program”) is a service delivered by Code for America on behalf of the people of California who may be eligible for Supplemental Nutrition Assistance Program (SNAP) benefits. Clients apply via the website and may be assisted by a CBO to apply for and maintain benefits. CBOs can apply to join the Program and use the GetCalFresh dashboard, communications, and outcomes data (“Service”).
Title to, and all Intellectual Property Rights in the Service, Website and documentation relating to the Service remains property of CFA. We reserve all rights not granted under these terms.
You must maintain strict confidentiality of all information and data accessed via the Service, to include but not limited to Confidential, Sensitive, or Personal Information.
“Confidential Information” is information that is exempt from disclosure or has restrictions on disclosure in accordance with applicable state or federal laws, including the California Public Records Act.
“Sensitive Information” is information, which is not confidential by definition, but requires special precautions to protect it from unauthorized access and/or modification. Sensitive information is information in which the disclosure would jeopardize the integrity of the CBO or CFA.
“Personal Information” is information that identifies or describes an individual (i.e., name, social security number, driver’s license, home/mailing address, telephone number, financial matters, etc.) and must be protected from inappropriate access, use or disclosure.

Only CBOs are authorized to use this website and will be granted access, no one else.
You will only use data accessed for the purpose of providing benefits support, processing, determination, reporting, and maintenance to clients of the Program. You agree that this information will not be used to identify program applicants or participants to any person not required to have access to such information. People allowed access to this information include but are not limited to county and CBO staff members. You may compile aggregate, de-identified reports, conduct analysis, and identify and elevate trends only to better understand and provide service to Clients and improve upon your program.
You will protect the data from any attempt or actual unauthorized acquisition, access, use, or disclosure of data in a manner which compromises the security, confidentiality or integrity of the information.
You are responsible for maintaining strict confidentiality and security standards and confirm that you understand:
You agree to implement administrative, physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the data that it creates, receives, maintains, uses, or transmits.
You must change default password as part of account setup and protect your password and credentials from unauthorized access.

We work hard to provide top-tier service to CBOs via the GetCalFresh service, but our service is provided “as is.” CFA does not warrant that the service will be uninterrupted or error free, nor does CFA make any warranty as to any results that may be obtained from use of the service. To the extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose, title and non-infringement.
Our liability will be limited to the fullest extent permitted by law, and under no circumstances will we be liable to CBO or any other party for any indirect, incidental, consequential, special or punitive damages for any matter arising from this agreement and use of the service. There is no fee for use of the service and CFA’s aggregate liability arising out of or relating to these terms will not exceed $10.
By using the service, you agree that the laws of the State of California will govern these terms of service, and any dispute that might come between you and CFA.
You, on behalf of the CBO, represent and warrant that:
CFA has the right to update this Agreement without notice by delivering the new terms to all current email addresses on file. Access or use of the Service after the date of amended terms will be deemed to constitute acceptance of the new terms.
This Agreement is effective upon your acceptance and will continue until terminated by either party with thirty (30) days notice. CFA has the right, at its sole discretion, to suspend access or terminate this agreement at any time, without limitation, if you have:
